If you do not agree, you must not use this website or our Services.

2. Nature of Services

  • Our Services involve evaluating whether you may qualify for a medical marijuana certification under applicable state law.
  • We do not provide primary care, emergency care, or general medical treatment through this website.
  • We do not grow, manufacture, distribute, or sell cannabis products and are not responsible for products obtained from dispensaries or third parties.

3. No Medical or Legal Advice

  • Information on this website is for general informational purposes only and is not a substitute for professional medical or legal advice.
  • You should always consult your own healthcare provider and/or attorney about your specific situation.
  • No physician–patient relationship is created solely by visiting this website.

4. Eligibility and User Obligations

By using this website and our Services, you represent and warrant that:

  • You are at least 18 years of age or otherwise legally permitted to use medical marijuana in your jurisdiction.
  • All information you provide, including personal, contact, and medical information, is accurate, complete, and current.
  • You will not impersonate another person or misrepresent your identity or medical history.

You are responsible for maintaining the confidentiality of any login credentials and for all activities under your account.

5. Medical Marijuana and Legal Compliance

  • Medical marijuana remains illegal under federal law and is only permitted in certain states and under specific conditions.
  • Laws and regulations regarding medical marijuana vary by state and may change over time.

6. No Guarantee of Certification, Card, or Results

  • Our clinicians determine whether to issue or renew a medical marijuana certification based on their independent professional judgment.
  • We do not guarantee that you will receive a certification, that a state agency will issue or renew a medical marijuana card, or that you will experience any specific health outcomes.  If you do not qualify for certification there will be no cost to you.
  • Your use of medical marijuana is at your own risk.

7. Telehealth and Electronic Communications

If we provide telehealth services:

  • By scheduling or attending a telehealth appointment, you consent to receive care via telehealth technologies (such as video, audio, or secure messaging).
  • You understand the potential risks of telehealth, including technical failures and privacy limitations, and agree to participate from a private location and use a secure internet connection when possible.

By using our website, you may consent to receive communications from us by email, SMS, phone, or through our booking application. Some of these methods may not be fully secure; by using them, you accept those risks.

 

8. Fees, Payments, and Refunds

  • Fees for evaluations, consultations, and related Services are disclosed prior to scheduling or payment.
  • Payment information is typically due at the time of booking, unless otherwise stated.  Your credit/debit card will not be charged until the service is completed. A medical marijuana certification is not guaranteed. If a clinician determines you do not qualify, you will not be charged a fee.
  • Unless explicitly indicated, we do not bill insurance and are not responsible for reimbursement from your insurer.

9. Risks and Side Effects

  • Medical marijuana may cause side effects, including but not limited to drowsiness, dizziness, cognitive changes, anxiety, or interactions with other medications.
  • You agree to carefully follow your clinician’s instructions, discuss potential risks and drug interactions with your healthcare providers, and avoid driving or operating heavy machinery while impaired.
  • Participation in the Medical Marijuana Program may affect your eligibility for certain licenses, including a Commercial Driver’s License (CDL) and/or a Firearm License.  Please consider this when making your decision and consult the appropriate authority if you have any questions.

10. Privacy and Security

  • We take reasonable measures to protect your personal and health information in accordance with applicable privacy laws, which may include HIPAA.
  • Our separate Privacy Policy explains how we collect, use, store, and share your information. By using our website or Services, you acknowledge and agree to our Privacy Policy.
  • No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

11. Intellectual Property

  • All content on this website, including text, graphics, logos, icons, images, videos, and software, is owned by or licensed to MMJ Medical Practice and is protected by intellectual property laws.

If a court or other authority challenges your certification by us, it may shift the risk/benefit calculation and we will be obligated to terminate your certification. Upon termination, your right to use the website and Services will immediately cease.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms, the website, or the Services shall be brought exclusively in the state or federal courts located in Essex County, Massachusetts, and you consent to the personal jurisdiction and venue of such courts.
